Terms and conditions

These terms apply to customers that use services of GameFeelings. Business that do business with GameFeelings cannot use this document for claiming rights.

GameFeelings delivers four distinct different services, with each their own terms and conditions:

  • The resources published by GameFeelings. Covered by section 1.
  • The shop and personal account system on this gamefeelings.com website. Covered by section 2.
  • The games build by GameFeelings, independent from this gamefeelings.com website. Covered by section 3.
  • The games published by GameFeelings, independent from this gamefeelings.com website. And their accompanied services. Covered by section 4.

1. Usage of the website as a resource

This is about the resources on this gamefeelings.com website (excluding the webshop and personal account system).

This is the exhaustive list the following term and conditions apply to

  • The blog on gamefeelings.com
  • The vlogs on YouTube on the official GameFeelings channel
  • The posts on Facebook, X (Twitter) and Instagram.

1.1 Limited liability

All information posted here is for inspiration only.

We strive to cover the subjects that we are expert on only. However we cannot guarantee that this will give you the same results as this did for us.

1.2 (Possibly harmful) statements

The statements that are on here reflect the mission and vision of GameFeelings. It can be different than what your values are, we ask for forgiveness if this is triggering to you.

However, if there is something on there that is encouraging wrong behaviour on others, please by all means contact us and we will try to work out something. Although we believe in the coexistence of conflicting believes and the massive value this gives to the world, we also dont live in a void where we can have it all our way and we know that. So if your open to constructive talks we will take it on us to find some kind of resolution.

1.3 Usage rights

The information we post here can be used with a good visible reference to us. We want to encourage sharing our (and your) experiences, but we should also be able to share in the benefits (from you sharing our resources).

We want visibility back in return. The amount we get must be relative to the substantial amount of work you take from it.

1.4 Availability

The availability of the information on this website: we do think that its valuable to keep things online as long as commercially possible.

Our pledge is that this is always in the form they were posted. If we alter it, its to point to newer information and/or newer perspectives (that we have) on the matter. We try to keep the old stuff available (but with context).

However, It can be that this gets confusing. In that moment we do try to keep the changes to a minimum. But it can be that parts or whole documents get altered. However thats never without context and we will tell what we did and why.

Our goal is to be open with information, but not to be hold accountable because this is a service we voluntary give not a requirement.

Excluded from this are the ‘technical’ documents and pages. Specifically but not limited to: ‘marketing landing pages’, ‘home page’, ‘contact page’, ‘game collection’, ‘about pages’, official required documents (the policies).

1.5 Personal information

On the resources there is no need for us to use your personal information. We might be using some general purpose data points to understand our audience and the performance of certain resources.

When you volunteer to share your details, like for instance when commenting on a resource or when you subscribe to a signal system to get updates, then that information is only used for the technical processing of that functionality.

It might be that the platforms we use to distribute our resources do additional tracking. Even on this website there might be more tracking due to the nature of technical components. See the privacy policies of these services for their details.

2 Usage of the shop and the personal account system

This applies to the shop and personal account system on this gamefeelings.com website.

  • The shop is the section under ‘/shop’ and ‘/product’.
  • The personal account system is under ‘/my-account’.
  • It also includes the payment options provided on this website.
  • It includes the delivery of the items bought in the shop.

It does not include

  • The games of GameFeelings sold outside of this shop (but these could still fall under section 3 or 4)

2.1 Offers

This is about the pricing, discounts and bundling of items.

We think that the pricing of the products on this store represents their real value. On this store you buy directly from us, the developer, and we do benefit more from this (than having these products on external platforms). However, the prices will be generally the same across all stores. This is intentional, we do think that our products are creative works that retain value indifferent of time and can be experienced on the same level now as years into the future.

The pricing can be adjusted to regions to offer more compelling offers that are scaled to the economic situation of that region. However we can change this, at will. And, to be honest, these offers are bound to the technicalities of being able to constrain them to customers specifically from that region.

Pricing can also be inflation adjusted, over time, without prior notice.

Specific offers are time bound. These time periods will be visible. We strive to keep us to the committed time periods, if technically possible. The offers are never ‘false’ offerings, with ‘off’ prices that were never really available. There is no guarantee that offers will get back.

If something is too good to be true, we probably made a mistake. Like selling a product for a (near) zero or a negative value. If that is the case, we reserve the right to roll back orders and delivery, without compensation.

We commit to having the proper taxes on the invoices. The way we see it, the final pricing of our products are the same for everybody and we take the tax difference. (This service is restricted to our shop on this website only, not on external platforms). However, our services are globally and it could be that a tax change was not (yet) registered with us. If there is something problematic with taxes, we try to make it our problem (as it should be with customer-business relationships), but we are limited on what we can do to how much money we make of you and/or the country (or global tax deal) you are part of (as in: we cant go net negative with such errors).

2.2 Delivery

In this shop we sell digital products only. If we ever sell physical products that will change this terms and conditions. For now this delivery is about the digital delivery of digital products.

The delivery of the GameFeelings games are on their respective platforms.

Games that sell in this store will have digital license keys that can be redeemed on the Steam platform. You need to have a Steam platform account to be able to redeem your key. For help with redeeming your key or using of the client, please look at their help page its very complete and helpful.

2.3 Payment

We use the payment provider ‘Mollie‘ to resolve our payments on this gamefeelings.com website.

The options provided on this payment provider are the only options we are able to provide currently. If you cant pay with one of these options, we are very sorry. We do want your money, but our resources (on financial administration) are limited due to us being a small company.

We do reimbursements, but its limited to the amount of the original transaction. And its limited to the original payment option used and original payment details used. Some reimbursement options are extremely expensive to us (way past the original value of the transaction), because of this we do reserve the option to sell to people only that we think will not cause too much reimbursements. See also 2.6 Warranty for more on reimbursements.

2.4 Personal information

For completing your purchase and order, we are legally required to get certain personal information. Also, the payment provider will ask for certain personal information to complete your transaction and being able to give us details about the transaction. This information will only be used to complete the order, and will only be retained for the required period.

2.5 Transfer of rights

We only sell licenses. You get the right to play the specific game on the specific platform you bought the key for, including the associated platform limitations that come with that.

You do not get the right to the game (content) itself, or its binaries, or distribution.

If there every might be a situation in the future that your game isnt available anymore on the platform you bought it on, we will do our best to provide you an option to play it on another platform without additional costs on your side. However this is available only to games that we can track on how they were sold, like on this website or on the Steam platform. And if the costs of providing this service is not economically reasonable, we also reserve the right to provide different options that are reasonable to us.

Also if you (or somebody else, could be even your country government) does something that will exclude you from the platform you bought the game for, we specifically hereby exclude that situation. We might, if the impact is big, try to work out something, but no guarantees on anything.

2.6 Warranty

We have a warranty system like Steam, in that we use your hours to determine if a charge back is viable. We use a 30m gameplay limit. We do need that you have bought it through our website and have the digital key available. Part of the charge back is that we invalidate your key for future usage, so understand that you cant use that key anymore. (Dont try to sell this key, it will get you banned because the keys will be flagged as not usable anymore. We told you.)

So yeah, you get your money back. Thats the warranty. If your game doesnt work on your pc: we reimburse you.

If you want help with getting the game to work, you can contact us at contact@gamefeelings.com and we can try to work out whats preventing you from enjoying the game. But know that the charge back is always an option, if you stay within the 30m gameplay limit and the payment rules and such.

Warranty is void if you temper with the digital products in any form or way.

2.7 Conflicts and mediation

Conflicts will be resolved in the Netherlands under Dutch law. Without exclusions.

Both parties will always try to settle outside court first, with a mediation option provided by GameFeelings. This mediation will not be aligned with GameFeelings, but can handle in favour of GameFeelings.

2.8 Liability

Using this shop, the payment options and this website is on your own risk. We do our best to keep our systems up-to-date and prevent accidental damages to you. But we cannot do the impossible.

If you actively abuse a system on this website and negatively affect other customers and/or the company GameFeelings, we will hold you liable for damages. No mediation in that case, we just go straight into the Dutch jurisdictional system no exceptions allowed.

3 Usage of the games build by GameFeelings

The games that fall under this are

  • Gearful
  • Find the Gnome
  • Find the Gnome 2

3.1 License

You get a license that grants you the right to play the specific game on the specific platform you bought the key for, including the associated platform limitations that come with that.

You do not get the right to the game (content) itself, or its binaries, or distribution.

We ensure that all the games content is created by ourselves, or that contractors worked for us, and/or that proper material usage is licensed us.

3.2 Experience

The features of the game are found on the platforms we market our games on. These features include the game play, the graphical content provided in the game, the emotional experience in the game, the length of the game, the technical requirements for the systems they need to work on. We strive to represent these features fully and honestly on the platforms we allow our games to be sold on.

The features of the game can change over time. We try to get these updates to be ‘better only’ and to provide more value and more technical compatibility.

However, it could be that you experience this as a downgrade. In that situation (for instance, but not limited to, due to expiring licenses or technical compatibility issues), we will try to get another version of the game out that doesnt contain said content or technical compatibility fixes if brought to our attention. It could be that this might alter the games original functionality, we strive to prevent that from happening and to provide equal alternative content, but we cant fully control this. We do not see those changes as substantial license agreement changes between you (the customer) and us (the service provider) and thus arent to be held liable for damages in that situation.

3.3 Delivery

The games we provide are for certain platforms only. In our case we mainly develop for Windows and Linux machines.

A game is a so called ‘binary’ and that data needs to be transported to your computer / device for you to experience our game. We have so called ‘platforms’ for that and they will handle the distribution for us and the (correct) installation of the game.

If there are delivery issues, you should contact the platform that you bought our game on.

3.4 Liability

We build the games we make with a lot of care. And we make sure that our games stay cared for, giving it updates over time.

We do this by utilizing the ‘Unity game engine‘, they are a market leader in game engines. They provide the so called ‘engine under the hood’.

This brings a distinction to the game on what we can and cant do. If its about ‘whats under the hood’ we are limited to the support Unity gives us. But if its about the ‘what we build on top of that’ we can and will try to find a solution to your issues.

However, we cannot break your computer with our game. Maybe the engine can, but we cant. So if you have the idea that our game broke your computer and/or device, please understand that we do not accept liability for that.

3.5 Personal information

We do try to not track you in our games. We really do not like those games ‘that call home’ to talk about you to us.

But we do employ a common ‘trick’ to get a sense of how our players play the game: the achievements are tracked by the platform and are connected to dashboards over on our side. We think this is okay information to use, because its very explicit, there is a reward for you in it, and the platforms provide a lot of options to manage this data for you.

However, we cant control what the platform the game is on tracks for it selves. Thats a bit of a shame, but this is how the world works. Steam is just the biggest one out there and we cant go around it (without severely hindering our commercial viability).

And here a bit of official talk: for a complete insight of the tracking we employ, see the privacy policy. It doesnt mention the tracking in the games itself and the achievement things, because thats not what that is about, but it will give you a sense of the tracking that is ‘around you getting to buy this game, play it, browsing on the platform, visiting your favorite social’ and how our company then might be ‘following’ you.

3.6 Excluded games

The games mentioned at the start of point 3 are the ones that these terms and conditions apply to. There could be more games out there that are build by GameFeelings. This subsection is about those games.

We do support these games, you can ask us for assistance. However, the assistance is limited in a commercial sense.

Games that we dont mention here but are part of a upcoming release (but that cant be public yet), get a lot of assistance. Games that we dont mention here because these were try-outs and never got released, these do not get assistance.

4 Usage of the games published by GameFeelings

Publishing games is something different from making the games. We make our games AND publish our own games at the same time.

Publishing is mostly about the money, marketing / finetuning, getting it in stores, customer service, and after-release care.

For now there are no games published under GameFeelings that are from other developers.

4.1 Marketing

We provide marketing for our games to make them reach the best fitting audience possible and have as much people possible enjoy our games. Not every game is for everybody, we understand this, and we use technology to find the best match between the games and their players.

For this marketing purposes we use a lot of data and tools. This is a section of the activities we employ, but its not limited to:

  • Being on conferences and events, talking with gamers about our game products. Getting to know you and understand what you like and dont like about our games.
  • Reading the comments on our video’s, reading the reviews on our games on the platforms, and participating in the forums where our games are discussed.
  • Analyzing the traffic to our website, our blogs and our video’s.
  • Tracking achievements in game, by the platforms the game is provided by.
  • Analyzing the data the platforms give us about our pages on the platform.
  • Doing ad campaigns on search and socials, and then tracking who interacts with what type of content.

4.2 Platforms

The platforms we are currently on with our games:

  • Steam
  • Itch.io
  • Google app store

We do focus our efforts on ‘payed’ full featured games. And the best fit for them is on the Steam platform. So that is where you will find the majority of our games.

It could be that we sell the game keys (to Steam) on different (bundle) platforms. Those wont be listed here.

Pricing is part of shop you choose to buy the game from. Steam is both a shop and a platform.

4.3 Delivery

The GameFeelings publishing is tightly integrated with the GameFeelings game development. However, for clarity sake, all visible manifestations of the GameFeelings products should be interpreted as the publisher speaking.

Maybe the blog section on the website is somewhat ‘pure’ GameFeelings developer talk, but even that is ‘colored’ by how the publishing wants the world to know about the game. (Yes thats weird if you think that its probably the same person, but see it as ‘having different hats that represents different responsibilities’).

For delivery on the platform specific services, go to the platform and view their terms and agreements. However, if you are on the platform and go to our game listing there and search for the terms and agreements, this will redirect you back to this document because the game service on the platform themselves is again governed by ourselves and you will need section 3 of this document for that.

4.4 Liability

Liability lies with the service used. See 4.3 delivery on the specific service and the liability.

If that doesn’t yield any results: we probably have a conflict. See 4.5 on that.

4.5 Conflicts and mediation

Conflicts will be resolved in the Netherlands under Dutch law. Without exclusions.
